1. Introduction
These Terms of Service (the "Terms") govern your access to and use of www.wildsetfree.com, any related pages, membership areas, video pages, galleries, newsletters, and other online services operated by WSF Enterprises, Inc. d/b/a Wild Set Free ("Wild Set Free," "we," "us," or "our") (collectively, the "Service"). By accessing or using the Service, creating an account, purchasing a subscription, or viewing content, you agree to these Terms.
If you do not agree to these Terms, do not access or use the Service.

2. Adult Eligibility
The Service is intended for adults. You must be at least 18 years old, or the age of majority where you live if higher, to create an account, purchase a subscription, or access members-only content. By using the Service, you represent that you meet these age requirements.
Our content may include swimwear, glamour, fashion, editorial, travel, behind-the-scenes production footage, and other mature themes. The Service is not directed to children or minors.

3. Accounts and Security

• You agree to provide accurate, current, and complete account information and to keep it updated.

• You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

• You may not share, sell, transfer, or sublicense your account or membership access.

4. Membership Tiers and Access
The Service may offer free access and paid subscription tiers. Current tiers may include:

Free — Access to the newest free release and selected public galleries or previews. Certain free areas may be ad-supported.

Basic — Access to the newest release plus the historical video archive, as described at checkout.

Premium — Full access to archive content plus behind-the-scenes, extended, full-length, or other members-only content, as described at checkout.

We may modify, rename, combine, discontinue, or change the features of any tier at any time, subject to applicable law and any specific commitments stated at the time of purchase. Content availability may change over time.

5. Subscriptions, Automatic Renewal, and Billing
Paid memberships are offered on a recurring basis, such as monthly or annual plans, unless stated otherwise at checkout. By purchasing a paid membership, you authorize us and our payment processors or platform providers to charge your selected payment method on a recurring basis for the applicable subscription fees, taxes, and other charges until you cancel.

• Subscription price, billing interval, renewal terms, and any free trial or promotional terms will be disclosed at checkout.

• Your subscription will automatically renew unless canceled before the renewal date through your account settings or other cancellation method we provide.

• If your payment method fails, we may suspend, downgrade, or terminate paid access until payment is successfully processed.

• We may change subscription prices or plan features prospectively. If required by law, we will provide advance notice and an opportunity to cancel before changes take effect.

Payments may be processed by Wix, Stripe, or other third-party payment providers. We do not store full credit card numbers on our own servers.

6. Cancellation and Refunds
You may cancel a subscription through your account, the subscription management page, or another cancellation method we make available. Cancellation stops future renewal charges but does not automatically entitle you to a refund for the current billing period unless required by law or expressly stated at purchase.
Unless otherwise required by law, subscription fees, digital access fees, and membership charges are non-refundable once billed. We may consider refund requests in our discretion but are not required to provide refunds.

7. Limited Personal License to Access Content
Subject to these Terms and your membership tier, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and stream content made available through the Service for your personal, non-commercial use only.
You do not acquire ownership rights in any videos, photos, text, graphics, logos, designs, music, trademarks, or other materials made available through the Service.

8. Restrictions on Use of Content
You may not, directly or indirectly:

• download, copy, record, screen-capture, scrape, archive, redistribute, sell, sublicense, publish, or publicly display any members-only content unless we expressly authorize it in writing;

• share login credentials or provide paid content to non-members;

• circumvent access controls, signed links, domain restrictions, paywalls, watermarking, rate limits, or technical measures;

• use our content to train artificial intelligence models or datasets without written permission;

• remove watermarks, copyright notices, metadata, or rights-management information;

• use images or footage of models, talent, creators, or crew in a way that implies endorsement, affiliation, or sponsorship without permission; or

• harass, stalk, dox, impersonate, exploit, or attempt to contact models, creators, crew, or other users in an abusive or invasive manner.

9. Photography, Video, Models, and Talent Rights
Wild Set Free content may include models, photographers, videographers, makeup artists, stylists, crew, locations, brands, products, and third-party property. You may not use, reproduce, manipulate, or redistribute any such content or any person’s name, image, likeness, voice, or persona except as allowed by these Terms.
Nothing on the Service grants you any right to contact, hire, solicit, repost, impersonate, or commercially exploit any model, creator, or other person appearing in the content.

10. User Submissions and Feedback
If the Service allows you to submit comments, messages, feedback, support requests, reviews, photos, or other materials ("User Submissions"), you represent that you have all rights needed to submit them and that they do not violate the rights of others or applicable law.
You grant us a worldwide, non-exclusive, royalty-free license to use User Submissions to operate, improve, market, and protect the Service. If you provide suggestions or feedback, we may use them without compensation or obligation to you.

11. Prohibited Conduct

• Use the Service for unlawful, fraudulent, abusive, harassing, defamatory, hateful, exploitative, or harmful purposes.

• Upload or transmit malware, scripts, bots, or code that interferes with the Service.

• Attempt to reverse engineer, probe, scan, scrape, overload, or compromise the Service or related systems.

• Misrepresent your identity, age, payment information, or authorization to use an account or payment method.

• Use the Service in violation of sanctions, export controls, or other applicable laws.

• Encourage or assist anyone else to violate these Terms.

12. Intellectual Property
The Service and its content are owned by Wild Set Free, its licensors, contributors, or other rights holders and are protected by copyright, trademark, publicity, privacy, contract, and other laws. All rights not expressly granted are reserved.
Wild Set Free, the Wild Set Free logo, and related names, marks, graphics, and branding are our trademarks or trade dress. You may not use them without our prior written permission.

14. Third-Party Services
The Service may rely on third-party providers such as Wix, Cloudflare Stream, Stripe, HubSpot, Google Analytics, advertising networks, email providers, and other vendors. Your use of or interaction with third-party services may be governed by their own terms and policies. We are not responsible for third-party services, outages, fees, processing, content, or policies.

15. Advertising, Promotions, and Links
Some free or lower-tier areas of the Service may display contextual or other advertising. Paid tiers may be ad-free if stated at checkout. We may also display affiliate links, sponsor messages, product references, or promotional materials. We do not endorse third-party products or services unless expressly stated.

16. Availability and Changes
We may change, suspend, remove, restrict, or discontinue any part of the Service or any content at any time. We do not guarantee that any specific video, gallery, feature, model, destination, or archive item will remain available permanently. We may need to remove content for legal, licensing, payment, security, platform, model/talent, or business reasons.

17. Account Suspension or Termination
We may suspend or terminate your account or access to the Service if we believe you have violated these Terms, engaged in fraudulent or abusive conduct, shared paid content, used unauthorized payment methods, created risk for the Service, or violated applicable law. If we terminate your account for violation of these Terms, you may lose access to paid content without refund, subject to applicable law.

18. Disclaimers
THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AVAILABILITY, SECURITY, ACCURACY, AND QUIET ENJOYMENT.
We do not warrant that the Service will be uninterrupted, error-free, secure, compatible with every device, or free of harmful components.

19. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WILD SET FREE AND ITS SHAREHOLDERS, DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, CREATORS, MODELS, TALENT, CONTRIBUTORS, AND VENDORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST DATA, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US FOR THE SERVICE DURING THE THREE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) USD $100.

20. Indemnification
You agree to indemnify and hold harmless Wild Set Free and its shareholders, directors, officers, employees, contractors, creators, models, talent, contributors, service providers, and affiliates from and against any claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys’ fees, arising from or related to your use of the Service, your violation of these Terms, your User Submissions, your infringement of rights, your payment disputes, or your unlawful conduct.

21. Dispute Resolution; Arbitration; Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. It affects your legal rights and requires most disputes to be resolved by binding individual arbitration rather than in court, except as stated below.
Informal resolution first. Before either party begins arbitration, the party raising the dispute must send a written notice describing the dispute and the requested relief. Notices to Wild Set Free may be sent by email to contact@wildsetfree.com or by mail to WSF Enterprises, Inc. d/b/a Wild Set Free at its Registered Office / Legal Notices Address: 3500 S. Dupont Hwy, Dover, DE 19901, United States. The parties will attempt in good faith to resolve the dispute informally for 30 days after the notice is received.
Agreement to arbitrate. Except for (a) claims that qualify for small claims court, (b) claims seeking injunctive or equitable relief for intellectual-property misuse, unauthorized access, or misuse of content, or (c) claims that cannot be arbitrated under applicable law, any dispute, claim, or controversy arising out of or relating to these Terms, the Service, your account, your subscription, or any content made available through the Service will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its applicable Consumer Arbitration Rules, as modified by these Terms. If AAA is unavailable, the parties will agree on another arbitration provider, or a court of competent jurisdiction will appoint one.
Arbitration procedures. The Federal Arbitration Act governs the interpretation and enforcement of this arbitration agreement. The arbitration will be conducted by a single arbitrator in English. Unless applicable law requires otherwise or the arbitrator determines that an in-person hearing is necessary, the arbitration may be conducted by video, telephone, or written submissions. The place of arbitration will be Delaware, but the parties may participate remotely where permitted by the arbitration provider.
Class action waiver. You and WSF Enterprises, Inc. agree that each may bring claims against the other only in an individual capacity and not as a plaintiff, class member, private attorney general, or representative in any class, collective, consolidated, or representative proceeding. The arbitrator may award relief only to the individual party seeking relief and only to the extent necessary to resolve that individual claim.
Jury trial waiver. To the maximum extent permitted by law, you and WSF Enterprises, Inc. waive any right to a jury trial for disputes subject to arbitration or otherwise permitted to proceed in court.
Opt-out right. You may opt out of this arbitration agreement by emailing contact@wildsetfree.com within 30 days after you first accept these Terms. Your opt-out notice must include your name, the email address associated with your account, and a clear statement that you wish to opt out of arbitration. Opting out of arbitration does not affect any other part of these Terms.
No limitation on non-waivable rights. Nothing in this section limits any non-waivable rights you may have under applicable law.

22. Governing Law and Venue
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules, except where applicable law requires otherwise. Subject to the arbitration provision above, the exclusive venue for disputes that are not subject to arbitration will be the state or federal courts located in Delaware, unless applicable law requires a different forum.

23. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted with a new effective date. If changes are material, we may provide additional notice, such as through the Service or by email. Your continued use of the Service after changes become effective means you accept the updated Terms, except where law requires additional consent.
